GENERAL TERMS AND CONDITIONS OF SALE
The general terms and conditions of sale (hereinafter "Conditions") shown on this page are valid for all purchase orders for our products (hereinafter "Products") made through the site massport.it (hereinafter "Site") and for all shipments in Italy and abroad of the Products thus purchased.
It is absolutely necessary to read carefully and fully and unconditionally accept these Conditions in order to proceed with the order. These Conditions, together with the order confirmation, form an integral part of the sales contract concluded with Mass Srl (hereinafter "MASS") for the purchase of the selected Products. Any changes to the contract itself can be accepted only if expressly agreed in writing by both parties.
MASS reserves the right to modify, supplement or simply update these Conditions at any time. They will always be accessible from the home page of the Site and will be binding from the moment of their online publication. Our customer service will be always available and can be of help in any case of doubts or requests for information.
The information on the Products published on the Site, although presented in detail and accompanied by product sheets with all the technical characteristics of the same (colors, sizes available, images and / or drawings), must be considered in a completely indicative way: color and other minor variations can always be found in the Products due to the use of different technologies for the acquisition and reproduction of images. MASS is not responsible for such variations and deviations.
Any information concerning the Products on the Site may be modified by MASS at any time and without notice. These changes will obviously not affect the orders already transmitted and which will have already been accepted by MASS in the ways and forms referred to in the following art. 2. MASS finally reminds you to pay maximum attention to the washing and storage instructions of the Products indicated on the labels of the same. MASS cannot in any way be held responsible for damage to the Products due to failure to comply with what is reported on the label.
To purchase Products through our Site you must be over 18 years of age. Orders through our Site are allowed only to final consumers and not to resellers. It is the customer's responsibility to ensure that the information provided to MASS when ordering is accurate and complete. Once you have made the choice of the Products you want to purchase, and completed the verification procedure, you will need to enter your personal data and details on the payment method. If you are already registered you will have to log in with your account, otherwise, you will have to register first. By submitting the order, the customer confirms that he is aware of these Conditions, accepts them unconditionally and undertakes to observe them. Otherwise, the order will not be accepted.
The customer agrees that his order is an offer to purchase the Products listed in the order itself, absolutely not binding for MASS, who has the right at any time to refuse an order without having to provide any explanation. After 7 working days without confirmation, the order can be considered refused. Failure to accept an order may depend on various causes, such as, for example: incorrect personal information; Ordered products not available; error on the Site relating to the products themselves; incomplete order.
Once the order has been placed, the customer will receive a notification of acceptance by email from MASS containing the order number and the data of the Products ordered, as well as information on delivery. The acceptance of the order and the formulation of the product sales contract between MASS and the customer will not actually take place until the customer has received from MASS an email confirming the shipment of the Products from our warehouse (any email order confirmation does not constitute acceptance of the order).
If MASS deems the order unacceptable, it will contact the customer by email or by telephone, in order to try to correct the information entered incorrectly, or I was able to suggest alternative Products in case of unavailability or error concerning the selected Products. If these attempts are not successful, MASS will cancel the order or will only deliver the Products available and will reimburse within 30 (thirty) days from the order those that it has not been possible to supply and for which the customer has already made the payment.
The prices indicated on the Site include VAT and are expressed in Euros (EUR). MASS reserves the right to make changes to the price as well as to the Products themselves, before the customer has placed his order. MASS reserves the right to change, limit or terminate any special offer or discount on the Products at any time. For the delivery of the Products, MASS applies variable shipping costs, which can be verified in the appropriate section Shipments . These delivery costs, if due, will eventually be charged separately and added to the total amount of the order.
To pay for the Products purchased and the related shipping and delivery costs, you can use different payment methods (eg credit card, debit card, PayPal, bank transfer, cash on delivery, etc.) indicated on the Site in the appropriate section " Payment Methods ". In case of payment by credit card, the customer must provide all the requested data. MASS carries out an individual credit check for each purchase, in compliance with its Privacy Policy . Based on the result of the verification, MASS reserves the right to refuse some payment methods. In any case, the shipment will take place when the payment has been completed. If MASS does not receive payment within 12 (twelve) working days from the date of the order, it will be canceled and the customer will receive an email confirming the cancellation of the order.
In the event that we choose, or are required by the laws in force, to send or make available a tax invoice, MASS reserves the right to send or make available the invoice in electronic format and the customer agrees to receive the invoice in this format.
The Products can be purchased only if the shipping address is in the same country as the buyer and will be delivered to the address specified in the order. Products purchased through the Site can only be shipped to countries for which MASS has entered into commercial agreements with the courier and indicated in the special section . The status of the order can be monitored by following the link in the email that our express courier will send to the customer as soon as the order has been processed.
MASS srl will deliver the goods to the address indicated by the customer when placing the order. MASS only delivers to homes or offices. Deliveries are made on working days, excluding midweek holidays in the country of delivery. Information on shipping and delivery times are indicated in the appropriate section . The expected delivery times are indicative.
You have the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party other than the carrier and designated by you acquire physical possession of the last good. To exercise the right of withdrawal, you must inform us (Mass srl, Via Strauss snc, 84091 Battipaglia (SA), Tel: +39 0828 301336 and info@massport.it) of your decision to withdraw from this contract by means of a declaration explicit (e.g. letter sent by post, fax or email). To this end, you can use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of additional costs resulting from your choice of a type delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, he will not have to incur any costs as a consequence of this reimbursement. The reimbursement may be suspended until the goods are received or until the consumer demonstrates that he has returned the goods, whichever is earlier. Please return the goods or deliver them to us (Mass srl, Via Strauss snc, 84091 Battipaglia (SA), Tel: +39 0828 301336 and info@massport.it) without undue delay and in any case within 14 days from day on which you communicated your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.

You are only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal pursuant to articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to: c) the supply of goods made to measure or clearly personalized
These Conditions govern all obligations and responsibilities relating to the supply of the Products. In cases not expressly contemplated herein, MASS does not recognize any guarantee, condition or other term that is binding on it regarding the supply or delivery of the Products. It will be the responsibility of MASS to inform the customer of any unforeseen event or in any case not attributable to its will as soon as possible. Finally, MASS will undertake to fulfill its obligations as soon as possible. If this interruption exceeds 15 (fifteen) days, the customer will have the right to cancel the order with consequent refund of any amount already anticipated.
MASS is particularly interested in safeguarding the privacy of its customers or simple users of its Site. The type of information collected and for what purpose, the particular circumstances in which it can be used or disclosed are described in the appropriate section relating to privacy , an integral part of these Conditions. By placing an order, the customer agrees and acknowledges that we may collect, use, store and process your personal data in accordance with our Privacy Policy .
The copyright on the entire content of the Site is and remains the property of Mass Srl, as well as all trademarks and distinctive signs present therein, as well as on products or packaging. The reproduction, in whole or in part, as well as the modification or use of such trademarks, illustrations, images, logos, for any reason and by any means, is strictly prohibited without the consent of MASS expressed in writing. Furthermore, the use of trademarks, of part or all of this Site on any other type of website or IT environment, is strictly prohibited, unless you have a written consent from MASS. The user is authorized to view, reproduce, print and download documents, audio and video materials found on the Site for personal, informational and non-commercial use only.
These Conditions are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206 on the Consumer Code as amended in implementation of Directive 2011 /83 / EU, with specific reference to the legislation on distance contracts.
